Regulation (EU) 2024/31110 – The new Construction Products Regulation – CPR

Regulation (EU) 2024/3110, adopted on November 27, 2024, supersedes Regulation (EU) No 305/2011, establishing harmonized rules for the marketing of construction products within the European Union. This regulation maintains the principle of subsidiarity, wherein Member States retain exclusive competence over construction works regulations, while the EU exclusively governs the internal market for construction products.
The Regulation adopts a performance-based approach, requiring manufacturers to declare their products’ performance in a harmonized manner that aligns with national requirements. The assessment methods and performance criteria are primarily developed through the European standardization system and according to standardisation requests issued by the European Commission. These standardisation requests are drafted in response to regulatory needs identified by Member States and, when necessary, European regulatory demands.

Serving as a robust regulatory framework, Regulation (EU) 2024/3110 shall ensure a level playing field in the European market by providing a unified technical language for assessments and declarations. This harmonization aims at facilitating the free movement of construction products and reducing assessment costs, thereby enhancing competitiveness.

To achieve European objectives concerning building performance, a coordinated approach involving both national and European actions is essential. The Regulation requires that Member States refer to the common technical language in their national provisions and refrain from requesting non-harmonized product information, thereby preventing barriers to trade.

As the principal regulatory instrument for construction products, Regulation (EU) 2024/3110 serves as the default legal framework for providing comprehensive product information, including aspects related to environmental impact, circularity, and the release of hazardous substances. The integration of environmental information into this regulatory framework was initiated when a standardisation framework (i.e. EN 15804) was developed to allow manufacturers the issuance of Environmental Product Declarations (EPDs). However, full implementation has yet to be achieved.

EPDs hold significant potential for ensuring the scientifically sound application of sustainability principles across Europe. They have been available for several years and are already a legal requirement in some Member States. Nonetheless, they remain voluntary and are not yet fully integrated into the common technical language. Importantly, Regulation (EU) 2024/3110 standardisation requests that EPDs must now be included in the Declaration of Performance and Conformity (DoPC), ensuring that environmental data becomes an integral part of the product performance information.
